Silicosis case: Limited leave to appeal granted
On Friday afternoon, the Gauteng High Court ruled on the request to appeal by mining companies in the silicosis class action judgment.
The court refused the companies leave to appeal the certification of the classes. However, it granted the companies leave to appeal on the issue of transmissibility.
In the judgment of 13 May 2016, the court ruled that heirs of mineworkers who died after 2012 will be beneficiaries of damages claims. The mining companies have been granted leave to appeal on this issue.
